New Regulatory And Tax Provisions On Real Estate Investment Funds

The Italian government has published a Law Decree containing several tax measures aimed at enhancing the economy and simplifying certain regulations. Taxand Italy provides a brief overview of these measures.

Among the tax provisions, new rules have been considered with respect to real estate investment funds, both from a tax and regulatory perspective, in particular with a different qualification of the "plurality of investors" condition. Different income tax regimes will be applied for participants depending on the portion of the quotas held in the funds. In the event of funds without a plurality of investors a transparent tax regime will be applied.
