Taxand Netherlands & Taxand UK VAT seminar on Pension Fund Management
Taxand Netherlands & Taxand UK hosted a breakfast VAT seminar focusing on pension fund management and recent ground-breaking European judgments on VAT treatment including the decisions in PPG, which led to HMRC revising its guidance on VAT recovery by employers, and ATP Pension Services which determined that managing a fund as part of a defined contribution scheme should be exempt from VAT.
Both of these cases will have had a significant impact on many employers’ and pension funds’ VAT recovery as well as that of fund managers themselves.
The seminar also covered the recent decision in Wheels Common Investment Fund Trustees Ltd and Others on the management of funds as part of a defined benefits scheme and discuss whether this is the end of the line for exemption of managing funds under a defined benefit scheme.

- Valentina Sloane, a barrister at Monckton Chambers, will discuss how the recent decisions affect both providers and recipients of pension fund management services as well as the potential for further litigation in this area. Valentina has represented several taxpayers at the European Court and House of Lords in leading cases including Fleming and Conde Nast on the legality of time limits for reclaiming VAT
- Lanre Peters, Head of VAT and Transfer Pricing at Fidelity Worldwide Investment, will talk about the impact of recent litigation from a fund manager's perspective
- Adam Katten, a Director of NLP Financial Management, will discuss pensions more broadly, including recent changes announced in the Budget and the phasing-in of pension scheme auto-enrolment for employees.
